1. Service Description

localvein is a market intelligence platform that helps marketing professionals discover and evaluate local businesses for prospecting purposes. The service provides business discovery, opportunity scoring, market demographic data, phone number classification, bulk phone classification (Pro plan), data enrichment services, and CRM-ready data exports.

2. Data Enrichment Services

localvein processes publicly available business data to generate intelligence signals that help you evaluate prospecting opportunities. These enrichment services include, but are not limited to:

• Website performance analysis: We assess business website speed and performance using publicly available testing infrastructure. This data reflects publicly accessible website behavior.
• Marketing tag detection: We analyze publicly accessible business websites to detect the presence of common marketing tools such as Facebook Pixel, Google Analytics, Google Tag Manager, and similar advertising or analytics tags. We only check for the presence of these tags — we do not access any data collected by those tags.
• Job listing detection: We check publicly available job board listings to determine whether a business is actively hiring. This data is sourced from public job postings and is used as a business health signal.
• Website Opportunity Score: We combine multiple publicly available data points (reviews, ratings, website presence, marketing tool adoption, and other signals) into a composite score that estimates how likely a business is to benefit from marketing services.
• AI-generated outputs: On eligible plans, a third-party AI language-model provider produces talking points, review sentiment summaries, and visual branding scores from publicly available business data. These outputs are generated by automated systems, may contain errors, and are intended as prospecting aids rather than definitive statements about any business.

All enrichment data is derived from publicly available sources. localvein does not access private systems, password-protected areas, or non-public data belonging to any business.

3. Account Terms

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the service. One person or entity may not maintain more than one account.

4. Billing and Cancellation

Paid plans are billed monthly in advance. You can upgrade, downgrade, or cancel your subscription at any time through your account settings. When you cancel, your access continues until the end of the current billing period. Refunds are not provided for partial billing periods.

5. Acceptable Use

You agree not to use localvein to:

• Harass, spam, or send unsolicited messages in violation of applicable laws
• Stalk, intimidate, or threaten any individual or business
• Engage in any activity that violates the CAN-SPAM Act, TCPA, or similar regulations
• Use business data for any illegal or fraudulent purpose
• Resell or redistribute raw data obtained through the service
• Attempt to reverse-engineer, scrape, or extract data from the platform beyond normal use
• Use enrichment data (opportunity scores, website analysis, hiring signals) to defame, publicly shame, or unfairly target businesses
• Misrepresent localvein data as your own proprietary research when communicating with prospects

localvein is designed for legitimate business prospecting. You are responsible for ensuring that your outreach activities comply with all applicable federal, state, and local laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and any relevant state-level telemarketing regulations.

6. Data Accuracy and Intelligence Disclaimer

All data provided by localvein — including business listings, demographic data, opportunity scores, phone number classifications, website performance metrics, marketing tag detection, and hiring signals — is provided on an "as-is" basis. localvein does not guarantee the accuracy, completeness, or timeliness of any data.

Intelligence signals are generated from automated analysis of publicly available information and may not reflect the current state of a business. Website performance scores may vary over time. Marketing tag presence may change as businesses update their websites. Job listing data reflects a point-in-time snapshot and may not indicate current hiring status.

You are responsible for verifying any data before taking action based on it. localvein is a prospecting tool, not a definitive source of business intelligence.

7. Phone Number Data

Business phone numbers displayed in localvein are sourced from publicly available business directories and listings. Phone line type classifications (mobile, landline, VoIP) are determined through third-party lookup services and are provided for outreach planning purposes only. Pro plan users may upload their own phone number lists for bulk classification, subject to a monthly lookup limit. You are responsible for ensuring you have the right to process any phone numbers you upload and for complying with all applicable telemarketing and communications laws when using this information.

8. Intellectual Property

The localvein platform, including its scoring algorithms, user interface, and proprietary data enrichment methods, is the intellectual property of localvein. You retain ownership of any lists or exports you create. You may not copy, modify, or create derivative works of the platform itself.

9. Limitation of Liability

localvein is provided "as is" without warranties of any kind. To the maximum extent permitted by law, localvein shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the service. Our total liability for any claim arising from these terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. Upon termination, your saved lists and search history will be deleted.

11. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by email or through a notice on the platform. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
